Affiliate program terms & conditions.
If you apply to become a Eroticaonline -affiliate you automatically agree to the complete terms and conditions of the Eroticaonline Affiliate program. These terms & conditions are:
1 .Your data & acceptance of application
You have to fill in the "Application form" completely and correctly. Eroticaonline has the right to refuse any application for whatever reason that could, according to Eroticaonline , be harmful to its name, brand, reputation, operation, or business. Eroticaonline also has the right to terminate the collaboration at any time with any affiliate during the Affiliate program. Beware that your application will automatically be revoked in case you do not fill in the "Application form" completely and correctly. In case your application is revoked, you will be notified by e-mail.
2. Responsibility of content on the Affiliate site
Eroticaonline is not responsible for the content on the affiliated sites and for any of their actions.
3. Personal links
As Eroticaonline creates personal links for every of Affiliate program-members, you must use the personal links provided to you by Eroticaonline . Eroticaonline is not responsible for any failure by you to use these Personal links. In case you do not use them Eroticaonline has no responsibility to grant any commission whatsoever. You will only earn commission on sales of Pricebreaker.es´s on Eroticaonline .com generated through the Personal links provided to you by Eroticaonline . Beware that you are not allowed to use the personal links provided to you by Eroticaonline for your own orders at Eroticaonline .com and/or Eroticaonline .be.
4 .Banners
You have to use banners provided by Eroticaonline . You can copy them on the Affiliate Program Homepage. Every link has specific banners that have to be used in accordance with it. The banners have to be used in the state you find them in on the Affiliate Program-homepage, and cannot be changed by you in any way. In case you have created a "Personal selection", you have to use the banner available, but you can adapt the banner to your needs by filling the blank space yourself. The Eroticaonline logo and text cannot be changed. By doing this you can exclude your site from the Affiliate program. Eroticaonline is not responsible for the banners if they are changed. Eroticaonline grants you a nonexclusive, revocable right to use these banners for the purpose of the Eroticaonline Affiliate Program. Eroticaonline reserves all the rights on the banners , our trademarks and trade names. Beware that you cannot put any price or delivery period information on Eroticaonline items on your site, as Eroticaonline can change its policies at any time, without notification.
5. Commission
Companies
You will receive a commission of 3% on all the items that are sold through your personal link(s), and that have been delivered to and have been paid by the customer. You can check out what your earnings are whenever you want by clicking the "Your report"-button on the Affiliate homepage.
Eroticaonline will pay the due amount after an invoice has been sent by the affiliate. At the end of each quarter (march - june - september - december), the affiliate can send an invoice for the amount to which he is entitled. The transfer cost to wire the money onto your account will be taken in charge by Eroticaonline if your account is in EU. In case your account is in a different country than EU, transfer costs will be divided (50%-50%) between you and Eroticaonline .
Only if all these details are on your invoice we will proceed with payment.
It is possible that you are not able to make an invoice, for instance because you do not have a VAT number. This is mostly true for those affiliates who do not have a business. Article 56 ° 2 of the VAT-manual has a special regime for small enterprises of which the annual turnover is not higher than 5577 Euro (K.B. nr. 19 dd. 29.12.1992) and who can be exempted from taxation for the services they give. Those who think they can benefit from this exemption, need to make a declaration of their activities at your local VAT-control office, with the request to benefit from the exemption. If you think you are entitled to this exemption, you can send an invoice to Eroticaonline with the statement: "Kleine onderneming onderworpen aan de vrijstellingregeling van belastingen. BTW niet toepasselijk" or "Small enterprise, subject to the tax-exemption. VAT not applicable" All the other data (see above) must ALSO be on the document (VAT/address of Eroticaonline ,...)
Personal Accounts
If you signed up for a personal account, you can redeem your commissions as discounts on our site, as long as you have a balance of at least 10 Euros on your Affiliate account. At the end of each quarter we will send you a gift voucher that you can redeem on our site.
6. Customers
Customers who buy products through these personal links will be considered as customers from Eroticaonline . Accordingly all Eroticaonline terms, policies, and operating procedures concerning customer orders, customer service, and product sales will apply to the customers coming through your personal Eroticaonline link. Eroticaonline has the right to change its policies and operating procedures at any time.
7. Press communications
You are not allowed to make any press releases regarding the Eroticaonline Affiliate Program or your participation in it without prior written agreement from Eroticaonline .
Using the name Eroticaonline or linking to the Eroticaonline site in communication to others (marketingcampaigns, email-actions or others) is only possible after prior written agreement with Eroticaonline .
8. Responsibility for the Affiliate site
The Eroticaonline Affiliate is solely responsible for everything regarding its site. Eroticaonline disclaims all responsibility for problems occurred through your site and the Affiliate cannot hold Eroticaonline responsible for any damage, claim and expense related to the Affiliates´s site. Eroticaonline is also not liable for special, indirect or consequential damages or loss of data, revenue, or profits arising in connection with the Eroticaonline Affiliate terms and conditions. The Affiliate cannot act as partner, joint venture, franchisee, sales representative, or employee of Eroticaonline , and has no authorization to act in the name of Eroticaonline .
9. Changes of agreement
Eroticaonline has the right to change any of the terms and conditions featured in this "Affiliate Program terms & conditions" at any time without prior acknowledgement. Every Affiliate will be notified of the change by e-mail. If the Affiliate doesn´t agree with the modification, its only recourse is to terminate the cooperation. Every Affiliate who doesn´t terminate the cooperation when there is a change in the terms and conditions, will automaticly accept the adapted terms and conditions.
10. Eroticaonline Affiliate terms & conditions
The Affiliate is committed to these terms and conditions from the moment they have filled in the "Application form". The Affiliate as well as Eroticaonline can terminate the cooperation at any time, with or without cause, by giving the other party written notice of termination. When the cooperation is finished, the Asssociate must immediately remove all Eroticaonline links and Eroticaonline trademarks from its site. No commission will be given on the items sold through a Eroticaonline link on the Affiliate site after termination of the cooperation. After termination of the cooperation the commission which has not yet been transferred to the affiliate´s account will be paid within one month. Eroticaonline also has the right to cooperate with websites which are similar to yours, are competitors, or opponents.
11. Acknowledgement of the Eroticaonline Affiliate terms and conditions
The Eroticaonline Affiliate acknowledges having read the " Eroticaonline Affiliate terms and conditions" competely and agrees to all its terms and conditions. The Affiliate chooses independently to participate in the Eroticaonline Affiliate Program following the complete terms and conditions as stated in the " Eroticaonline Affiliate terms and conditions", without relying on anything else than the terms and conditions stated in these " Eroticaonline Affiliate terms and conditions".
